Road Construction

Plowing

I would like to remind residents of Section 1219 of the Vehicle and Traffic Law and Section 214 of the Highway law of New York State. These laws specifically prohibit the placing or leaving of snow, ice or other substance upon any highway, which includes pavement, shoulders, and ditches. Plowing snow from a driveway across the road and piling it on shoulders or in ditches can cause serious injury to persons traveling the road, and it also causes flooding. When the weather breaks and things start to thaw, the snow piled in ditches keeps water from draining normally. In the winter season, violating either of these laws could result in a summons from a local police agency to be issued to the responsible party. I realize that sometimes this is the most convenient way to get rid of the snow from driveways, but I ask all residents who currently use this method when clearing snow from their driveways to find an alternate place to deposit the snow during the winter season. Your cooperation in this matter would be greatly appreciated.
