ZONING BOARD OF APPEALS MEETING
January 28, 2019
The Town of Royalton Zoning Board of Appeals Meeting was held on Monday, January 28, 2019, at the Royalton Town Hall, 5316 Royalton Center Road, Middleport, New York. The meeting was called to order at 7:30 PM by Chairman Philip Gow.
The following were present:

There is one (1) Public Hearing on the agenda this evening.
SPECIAL USE PERMIT-ROBERT AND HEATHER MATTISON-4049 ROOT RD GASPORT,NY 14067
Chairman Philip Gow opened the Public Hearing to consider the application for a temporary use permit to permit the operation of a bed-and-breakfast on premises located at 4049 Root Rd, Gasport, NY 14067.
Heather Mattison was present. She explained that she has a 4000 square foot Victorian home with 7 bedrooms. It also has a servants quarters. She would like to open up a bed-and-breakfast there. The health department has inspected it.
It is an historical location. It is in close proximity to Becker Farms. There are also wineries and antique stores nearby. Heather and Robert have approached the wineries to let them know that they may be opening a bed-and-breakfast. A lot of people from the wineries are interested in staying there. Some of the wineries have offered to do wine tasting at the bed-and-breakfast. Heather said that may be something they are interested in offering at the facility.
Heather presented the ZBA with a prototype flier of the bed-and-breakfast. There will be 3 bedrooms for rent. Check in will be at 3 PM and check out will be at 11 AM. They are still deciding whether they will be seasonal or open year round. Michael Hartman asked if they would be having weddings there. Heather said there are no plans for that right now but it could be a possibility in the future.
They have done a lot of work to the inside of the home. In the spring they will work on cleaning up the outside. Gardens will be put in and sidewalks. The driveway will be restoned and parking will be to the right.
Michael Hartman asked where the septic is located. It is next to the porch.
Michael Hartman asked about signage. Heather said she would like signs near the end of the driveway. Michael stated that according to code 200-13 subsection H signs shall not exceed 32 square feet in area in total accumulation of all signs.
There are no comments from the public.
Chairman Philip Gow closed the Public Hearing at 7:45 PM.
The SEQR passed with a negative declaration. There is no environmental impact.
TEMPORARY USE PERMIT
On a motion made by ZBA member L. Budde, seconded by J. Genet-Haseley the following was
ADOPTED AYES 5-P. Gow, C. Kelley, G. Lindke, L. Budde, J. Genet-Haseley
NAYS 0 MOTION CARRIED
Thomas Brandt stated that according to the Public Hearing notice this is a Special Use Permit. A bed-and-breakfast falls under the category of a Special Use Permit.
Philip Gow amends the motion to change the language from a Temporary Use Permit to a Special Use Permit.

NAYS 0 MOTION CARRIED
RESOLVED to authorize the Special Use Permit for Robert and Heather Mattison, 4049 Root Rd, Gasport, NY 14067 to permit the operation of a bed-and-breakfast on premises as long as they meet all the New York State requirements for a bed-and-breakfast.
Michael Hartman will conduct a joint training session with the Zoning Boards and Planning Boards from both the Town of Royalton and the Town of Hartland on February 20, 2019 at 6 PM at the Royalton Town Hall. He has also invited Newfane and Newstead. Heather Lewis from the Town of Royalton Planning Board may invite Drew to come in and train too.
Philip Gow brought up the point that they are the Zoning Board of Appeals. Michael Hartman stated that the Town Board appoints tasks and it is a task that Dan Bragg said they should pick something to work on.
Michael Hartman suggested the portions of the code that the ZBA should be working on. They can look at trailers again. In definitions they can say what is a customary storage. A new trailer law is needed. This is important. The junk law in town also needs to be reviewed. Post beam structures being used as living space is another issue that needs to be addressed.
Michael Hartman has been working on the annexation survey for the Northeast corner of the canal. This is owned by Common Ground Synergy and has been annexed to the Town of Hartland. Hartland is part of the canal corridor. This has already been approved but has not happened. This will change the boundaries. He needs help with this from the ZBA.
The ZBA has no new business to discuss.
