PUBLIC HEARING
LOCAL LAW #1 FOR 2012 - LOCAL ROAD STANDARDS FOR THE TOWN OF ROYALTON
July 9, 2012
The Public Hearing of the Town of Royalton was held on Monday, July 9, 2012, at the Royalton Town Hall, 5316 Royalton Center Road, Middleport, New York. The meeting was called to order by Supervisor Jennifer H. Bieber at 7:00 PM with the Pledge to the Flag.

The purpose of this Public Hearing was to hear and consider information pertaining to the proposed Local Law #1 for the year 2012 entitled "Highway Standards for Low Volume Roads in the Town of Royalton".
Mr. Thomas Brandt, Town Attorney, explained the need for this Local Law and gave information on what this means to our town. This has been done for legal concerns for the Town of Royalton once we have been put on notice regarding a certain situation on a specific road.
Mr. Douglas Bennett, Town Engineer, stated that the Local Law allows the town to come up with reduced standards for other roads in the town as necessary. Tonawanda Creek Road is an example of a road that is not conducive to the NYS DOT standards.
Mr. James Kelly, resident, asked if this will be an on-going process or if it will be done on a case-by-case basis.
Councilman Daniel Bragg stated that this Local Law will allot us to align it with our Master Plan. This gives the town the ability to reduce speed on a road as necessary without petitioning the NYS DOT.
Mr. Scott Wymczak, resident, asked if this will be used as a loop hole.
Councilman Bragg stated that this will be used to allow the town to petition the residents on a certain road to see what they want to have done.
Attorney Brandt discussed abandoning roads if necessary.
Mr. Terry Nieman, Highway Superintendent, stated that the town is being pro-active by putting the Local Law in place to protect the town from future law suits.
There being no further information or questions to come before this board pertaining to the proposed Local Law, a motion was made by Councilman Budde, seconded by Councilman Rehwaldt and carried unanimously that the Public Hearing be closed at 7:17 PM.
